Az Általános Szolgáltatási Feltételek („ÁSZF”) tartalmazzák a COLORICA Kft. cég (székhely: 1237 Budapest, Hrivnák Pál u. 165. 1.a.), adószám: 24134253-2-43), mint szolgáltató (“Szolgáltató”) által üzemeltetett webáruház használatára vonatkozó általános szerződési feltételeket. Kérjük, hogy csak akkor vegye igénybe szolgáltatásainkat, amennyiben minden pontjával egyetért, és kötelező érvényűnek tekinti magára nézve. Jelen dokumentum nem kerül iktatásra, kizárólag elektronikus formában kerül megkötésre (nem minősül írásba foglalt szerződésnek), magatartási kódexre nem utal.

Alapvető rendelkezések

1.1. A jelen Szabályzatban nem szabályozott kérdésekre, valamint jelen Szabályzat
értelmezésére a magyar jog az irányadó, különös tekintettel a Polgári Törvénykönyvről
szóló 2013. évi V. törvény („Ptk.”) és az elektronikus kereskedelmi szolgáltatások,
valamint az információs társadalommal összefüggő szolgáltatások egyes kérdéseiről
szóló 2001. évi CVIII. törvény vonatkozó rendelkezéseire. A vonatkozó jogszabályok
kötelező rendelkezései a felekre külön kikötés nélkül is irányadók.
1.1. Megvásárolható termékek, szolgáltatások köre

1.6. A megjelenített termékek csak online megvásárolhatók. A termékek árai tartalmazzák az áfát. A megjelenített termékek letölthető tartalmak, ezért az árak nem tartalmaznak sem házhozszállítási, sem csomagolási díjat.

1.7. A webshopban Szolgáltató részletesen feltünteti a termék nevét, leírását, a

valóságostól, bizonyos esetekben illusztrációként szerepelnek.

Order process
1.9. Rendeléshez kosárba helyezi vevő a termékeket kosárba helyezés gomb megnyomásával egy termék adatlapján belül. Amennyiben a vásárlást realizálni szeretné regisztrálnia szükséges, vagy korábbi regisztrációja belépési adatainak felhasználásával be kell lépnie saját felületére. Regisztrációkor megadja elérhetőségi adatait. Ezután kiválasztja a fizetési módot, ami előreutalást jelent: paypal (egyelőre ki van kapcsolva) vagy banki átutalás. Az összeg bankszámlára beérkezésekor Szolgáltató komplettírozza Vevő megrendelését a webshop háttérrendszerében, aminek következtében a korábban kiválasztott és megrendelt letölthető dokumentum vagy annak hivatkozása megjelenik Vevő saját webshop-felületén, letölthető link formájában. Ezzel egy időben Vevő értesítést kap az Eladó teljesítéséről. A link ezt követően 72 órán át elérhető marad Vevő számára. Amennyiben Vevő ez alatt a 72 óra (3 nap) alatt nem töltötte le a megvásárolt terméket és erről jelzést küld Szolgáltatónak, akkor Szolgáltató köteles még egyszer legalább 24 óra (1 nap) időtartamra újranyitni a letöltési lehetőséget Vevő részére, 13 napon belül, a Vevőnek megküldött első értesítést követően. Ha ez alatt az idő alatt sem sikerült Vevőnek letöltenie, akkor a Szolgáltató az ügyletet az első értesítést követő 14. nap után lezártnak tekinti. Kivéve, ha ezt megelőzően Vevő elállási szándékát jelezte Szolgáltatónak (ld. lejjebb).

At the same time, the Buyer receives a notification of the Seller's performance. The link will then remain available to the Buyer for 72 hours. If the Buyer has not downloaded the purchased product within these 72 hours (3 days) and sends a notification to the Service Provider, the Service Provider is obliged to reopen the download option for the Buyer for at least 24 hours (1 day), within 13 days, after the first notification sent to the Buyer. If the Buyer has not been able to download it during this time, the Service Provider considers the transaction closed after the 14th day following the first notification. Unless the Buyer has previously notified the Service Provider of his intention to withdraw from the contract (see below).
1.10. Amennyiben Vevő téved, vagy hibásan állítja össze kosara tartalmát a webáruház felépítése lehetőséget ad a tévedés kijavítására, így törölheti a tévesen kiválasztott termék tartalmát bármikor a megrendelés elküldése előtt. 1.10. számított, a szolgáltatás jellegétől függő elvárható határidőn belül, de legkésőbb 48
órán belül az igénybe vevőhöz nem érkezik meg, az igénybe vevő mentesül az ajánlati
kötöttség vagy szerződéses kötelezettség alól. megrendelés és annak visszaigazolása
akkor tekintendő a szolgáltatóhoz, illetve az igénybe vevőhöz megérkezettnek, amikor

felszólítás hiányában legkésőbb a megrendelésnek Szolgáltatóhoz való megérkezésétől
számított harminc napon belül köteles a szerződés szerinti teljesítésre.

de legkésőbb harminc napon belül visszatéríteni. E kötelezettség teljesítése
Szolgáltatót nem mentesíti szerződésszegése egyéb következményei alól.
1.15. 1.16. A fogyasztó és a vállalkozás közötti szerződések részletes szabályairól szóló
45/2014. (II.26.) Korm. rendelet szabályozása értelmében a Felhasználó a megrendelt
termék kézhez vételétől számított 14 napon belül indoklás nélkül elállhat a szerződéstől,
visszaküldheti a megrendelt terméket, de ez a 14 napos elállási idő nem vonatkozik az online digitális tartalmakra, ha már megkezdte a letöltést vagy az adatátvitelt (streaming), és elfogadta, hogy a letöltés, illetve adatátvitel megkezdésekor elveszti elállási jogát.

Szolgáltató fenti esetek teljesülésekor vállalja, hogy legkésőbb 14 napon belül visszautalja a megrendelés ellenértékét Vevőnek azzal a kitétellel, hogy az összes utalással és deviza átváltással járó banki költség megfizetése a Vevőt terheli.
1.17. 1.18. Az általános kellékszavatosságon túl termékeinkre 1 hónap digitális működtethetőségi garanciát vállalunk. A letöltött adatfájl hibája esetén a garancia érvényesíthető. Ekkor a sérült, vagy hibásan működő adatfájlt kijavítjuk és az elvárt működést nyújtó adatfájlra cseréljük. Ehhez kérjük elérhetőségeink valamelyikén (den@denmusic.hu) tájékoztatni szíveskedjenek a hibáról és annak leírásával segíteni szíveskedjenek a javítási folyamatot.
1.18. Beyond the general warranty of goods we offer a 1-month digital operability guarantee for our products. In the event of an error in the downloaded data file, the warranty can be enforced. .19. A denmusic.hu webshopból letölthető termék(ek) szerző(k) szellemi tulajdona és szerzői jogvédelem alatt áll(nak). Eladó kiköti, hogy Vevő nem értékesítheti tovább az általa megvásárolt és letöltött terméket Eladó külön aláírt szerződéses engedélye nélkül. Amennyiben Eladó gyanús aktivitást észlel mind regisztrációt, mind saját felületre csatlakozást, mind letöltést és egyéb rendellenes aktivitást illetően fenntartja magának a jogot, hogy beavatkozzon a gyanúsnak vélt aktivitás azonnali megszűntetése érdekében, kivizsgálja az eseményt és következményeit, valamint megalapozott esetben hatósági eljárást kezdeményezzen.

1.21. Szolgáltató és Felhasználó vitás ügyeiket békés úton próbálják rendezni.
Felhasználó és a Szolgáltató a jelen Szabályzat hatálya alá tartozó, megegyezéssel 30
(harminc) naptári nap alatt nem rendezhető esetleges jogvitákra nézve kikötik a Budapesti XX., XXI. és XXIII. Kerületi Bíróság illetékességét.
